1. PROMOTION ORGANISER

The companies belonging to the INVERSIONES PLOMER S.L. Group (through its trademark ZAFIRO HOTELS), located in C/Mar i Estany, 35, 07400 Puerto de Alcudia, Balearic Islands, Spain, with fiscal ID number B-07985823 organises this online prize competition (hereinafter, the "Promotion") in accordance with the Participation Requirements section below.
This prize competition aims to reward the loyalty of fans of the brand in social media.

2. PARTICIPATION REQUIREMENTS AND PROMOTION PROCEEDURE

Participation requirements are as follows:
- Participants may reside in any country but must be over 18 years of age.
- Participants must have an Instagram or Facebook account.
- Participants must publish a photo of themselves on the Zafiro Hotels podium set up near the ZAFIRO HOTELS stand at the Zafiro Palma Marathon 2019 on their Instagram or Facebook profile.
- The text that accompanies the photo must include the hashtags #iamthewinner and #zafiropalmamarathon
- Participants may only participate with one single Instagram or Facebook account. If a Participant is found to have used several Instagram or Facebook accounts, they will be disqualified. For this purpose, and at the discretion of ZAFIRO HOTELS, a duplicate profile is considered to be one whose email or personal data are sufficiently similar to create confusion.
- Participants must follow Zafiro Hotels in their Facebook or Instagram accounts:

o Facebook: https://www.facebook.com/ZafiroHotels/
- If more than one person appears in the photo, the others may also participate in the prize competition after making a separate publication that complies with all of the requirements herein.
- A maximum of 3 photos per participant will be accepted.
- The Instagram or Facebook profile must be real and not based on a false identity. This assessment will be made at the discretion of the Organiser.
- Under no circumstances will any bad language, explicit or implied insults, disrespect for third parties or inappropriate content be accepted, nor any content that ZAFIRO HOTELS may consider inappropriate in ensuring the successful completion of the Promotion.

3. PROMOTION CONDITIONS

Participants that comply with these terms and conditions from 11am on October 11, 2019 until 11: 59pm on October 13, 2019 (local time) will enter the prize competition.
The winners will be named from October 30, 2019. Winners will be notified by a post and private message on Instagram or Facebook. If the prize is rejected or the winner does not meet the Promotion requirements, ZAFIRO HOTELS will inform a reserve winner. ZAFIRO HOTELS reserves the right to disqualify participants using inappropriate names, names owned by third parties, names containing trademarks or protected intellectual property, participants using false profiles or any other participants that contravene the spirit of the Promotion in general. In such cases, participants will forfeit their right to take part. Participation is not admitted for employees of ZAFIRO HOTELS or ZAFIRO PALMA MARATHON nor any other people cooperating directly or indirectly with either.

4. PRIZE

The prize is a 2-nights stay in 2020 and subject to room availability for two people on a half-board basis at any of the hotels operated by ZAFIRO HOTELS. If no rooms are available for the chosen dates, alternative dates will be proposed. The prize may not be exchanged for cash or an alternative prize, nor may it be changed or replaced.
The prize competition itself and the prize are subject to applicable tax regulations.

5. DELIVERY OF THE PRIZE

All the photos that meet the requirements described previously will enter the prize competition. The best photos will be chosen by a ZAFIRO HOTELS jury. The quality, originality and creativity of the photo will be taken into account in choosing the winner. ZAFIRO HOTELS reserves the right to cancel the Promotion If there are not enough valid photos to qualify for the prize or for any other internal reasons.
Winners will be announced in a post and by private message on Instagram or Facebook through the ZAFIRO HOTELS profiles. Winners must accept the prize and provide their personal data by email to the address included in the private message or by replying directly to the email notification.
If no reply confirming receipt and accepting the prize is received within 24 hours of notification being sent, the prize will be awarded to the reserve winner. If the reserve winner does not confirm receipt and accept the prize, the Promotion will be declared void.
By accepting the prize, winners accept that ZAFIRO HOTELS may use their name and image or photo for promotional purposes through any media with no need to give notice. The Organiser may eliminate any participants who do not comply with the previously mentioned requirements or who intend to participate in violation of these terms and conditions.

6. DISQUALIFICATION AND PENALTIES

If any participants do not meet the requirements of these terms and conditions or if the data provided is not valid, their participation will be considered void and they will be automatically disqualified from the Promotion, losing any rights to any prizes.

7. DATA PROTECTION

Participants’ data will be transferred to an automated file owned by ZAFIRO HOTELS as defined in Personal Data Protection legislation and the company's privacy policy. All personal information that participants provide to the Organiser during the Promotion will be totally confidential as required by General Data Protection Regulations (Regulation UE 2016/679).
The company responsible for data collection and processing is Inversiones Plomer S.L. (B-07985823), located in C/Mar i Estany, 35, 07400, Puerto de Alcudia, Spain. You can contact us by email to privacy@zafirohotels.com. The purpose of collecting and processing your data is to carry out the prize competition.
The company is legitimised to process your data by your participation in the prize competition and based on the consent granted through this form. The processing of your data is essential for carrying out the prize competition.
We also inform you that, where appropriate, your data will be transferred to any relevant public authorities and to any person involved in the organisation of the Promotion in order to communicate and deliver the prize.
We will keep your personal data for 5 years, the period for which civil, criminal or administrative liabilities may arise for Inversiones Plomer S.L. as a result of any irregularities during your stay or for any possible responsibilities arising from data processing. After 5 years, the data will be destroyed.
In addition to the right to withdraw your consent for data processing at any time, the processing of your personal data also gives you the following rights:
• You may request access to all your personal data that we process (right to access)
• You have the right to correct your data (right to correct).
• You may request the deletion of your data when the requested service has been completed (right to cancel).
• You have the right to request that your personal data is not processed (right to oppose).
• You may also request limitations to the processing of your data (right to limit processing).
• You have the right to have your personal data delivered to you digitally so that you may process it (right to portability).
The acceptance of the prize does not imply the acquisition of any kind of additional products or services. Participants accept that ZAFIRO HOTELS may use their name for promotional purposes.
The successful completion of this prize competition requires that the data provided by participants are accurate. If the personal data is inaccurate, incomplete or outdated, making it impossible to identify participants and prize-winners by reasonable means, the Organiser reserves the right to declare the Promotion void, remaining free of all responsibility in this regard.

8. LIABILITY DISCLAIMER

We do not assume responsibility for any circumstances related to, but not limited to, any loss, theft, delay or any other circumstance attributable to third parties that may affect this Promotion, nor are we responsible for the use of the Promotion prize by the participant.
We do not assume responsibility in the event of force majeure or any other fortuitous event that may prevent the completion of the Promotion or full or partial enjoyment of the prize.

9. APPLICABLE LEGISLATION AND JURISDICTION

These legal terms and conditions will be governed by Spanish law and the resolution of any claims arising in relation to the validity, interpretation or fulfilment of these terms and conditions will be subject to the Courts and Tribunals of Palma de Mallorca (Balearic Islands).
